According to the law 207 from the 2nd of June 2009, only the protected units created within disabled persons’ organizations are allowed to undertake sales/intermediation activities, on the condition that at least 75% of the obtained profit to be used in programs for the socio-professional integration of disabled persons from the respective organization.  These units are compelled to present a financial report at the beginning of each year illustrating the use of the funds obtained for the commercial activity.
„The Parliament chose to supply a source of income to the disabled persons’ organizations with these protected units functioning within the organizations. We are hoping that, at least now, the responsible organs shall start to check the fake protected units and penalize the transgression of the provisions of the Law   448/2006.” stated Laila Onu, manager of „Pentru Voi” Foundation.
What was happening before?
As a consequence of the legislative provisions meant to encourage the employment of disabled persons, a series of “fake protected units” misusing money from the state budget making disloyal competition to those units that truly hire disabled persons. The funds that should have been paid to companies and public institutions according to the Law 448/2006 reached actually into the pocket of some immoral opportunists. The training programs of large companies or even the purchase of motor scoters for postmen to be supplied through fake protected units that were intermediating the services. 
The Law 207/2009 approves the Emergency Decision of the Government no. 86/2008 for the change of the Law no. 448/2006 regarding the protection and promotion of disabled persons’ rights.
