Art. 78.

(1) Persons with disabilities can be employed according to their professional background and working capacity, as attested by the disability class certificate issued by the assessment commissions from the county level or from the districts of Bucharest.

(2) The authorities and public institutions, and legal entities either private or public which have at least 50 employees shall be bound to hire disabled persons representing at least 4% of the total number of employees.

(3) The authorities and public institutions, and legal entities either private or public who do not hire disabled persons pursuant to paragraph (2) may choose to fulfill one of the following obligations:

a) To pay to the state budget, on a monthly basis, an amount representing 50% of the gross minimal national salary multiplied by the number of positions on which they failed to hire disabled persons; 

b) To acquire products or services from authorized protected units, on partnership bases, in an amount equivalent to the amount due to the state budget under subparagraph (a).

(4) The public national defense, public order and national security institutions shall be exempted from the provisions of paragraph (2).

(5) The observance of the provisions of paragraphs (2) and (3) shall be monitored and controlled by the Labor Inspection.
